Legal measures advance to regulate the cryptoasset market

Resolution No. 05/2025/NQ-CP established a five-year pilot period to regulate the cryptoasset market in Vietnam, setting a progressive monitoring of the rules according to the sector’s evolution. The Ministry of Finance (MoF) was defined as the main authority responsible for the supervision and regulation of this area.

According to Article 17 of the resolution, it is the MoF’s responsibility to create a decree detailing the applicable administrative sanctions, a document already submitted to the government for analysis. In addition, the ministry is preparing three circulars for the first quarter of 2026, which should guide aspects related to accounting, auditing, and taxation in the cryptoasset market.

Since January 20, 2025, an official portal has been available for the registration of service providers in the segment, aiming to centralize control and ensure transparency of operations. At the same time, the State Securities Commission (SSC) of Vietnam presented proposals for ministerial decisions to strengthen the provisions of Resolution No. 05.

Decision No. 96, which defines administrative procedures related to the sector, was submitted for publication by the Ministry of Finance, tightening the regulatory framework. During the pilot period, cryptoasset exchanges should serve both local investors using foreign platforms and international investors with a presence in the country.

Finally, it is worth highlighting that the Digital Technology Industry Law, approved in June 2025 and effective since January 2026, incorporated provisions related to digital assets, aligning the national legal framework with market requirements. Thus, Vietnam is advancing in building a structured regulatory environment for the cryptoasset segment.

Context and Perspectives of Cryptoasset Regulation in Vietnam

The debate on the legal regulation of cryptoassets in Vietnam has lasted for approximately a decade, involving discussions by different government ministries. Although recognized as assets due to their characteristics of identifiable value and legal existence, cryptoassets will not have their treatment incorporated into the Civil Code, which regulates stable social relations and does not apply directly to this new class of assets.

The strategy adopted so far favors a gradual approach, aiming for the market development in a safe manner with investor protection as a priority, according to statements from regulatory authorities. Furthermore, the global flow of capital related to cryptoassets exceeds 220 billion dollars, which demonstrates the economic relevance of this segment and justifies Vietnam’s interest in structuring its own legal environment.

The local market presents a relatively high volume in global comparison, driven by a significant presence of qualified professionals in the information technology area. On the other hand, Vietnam faces pressure from international organizations, such as the Financial Action Task Force (FATF), to implement strict measures against money laundering and terrorism financing, directly impacting the formulation of regulation.

Decisions related to the approval of specific legislation for cryptoassets may occur before the conclusion of the current five-year pilot period, which assesses the effectiveness of measures adopted at the moment. If the results are positive and there is social acceptance, the expectation is that a special regulation will complement Resolution No. 05, which currently defines the sector’s foundations.

In general, Vietnam has sought references in international regulatory models to accelerate the development of the local market and ensure an adequate normative structure. In this way, the country intends to balance innovation with the legal security required in this dynamic and rapidly evolving environment.
